Terms & Conditions TrueGrimmStories
Effective date: 01 October 2025
1) Who We Are & Scope
These Terms & Conditions (“Terms”) govern your access to and use of truegrimmstories.com, related sub-pages, our newsletter, social and video embeds, links to third parties, merchandise pages, affiliate links, and tips pages (collectively, the “Services”).
“TrueGrimmStories,” “we,” “us,” or “our” refers to our brand.
By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2) Age & Audience
Our content features original Brothers Grimm stories and may include dark or mature themes. The Services are intended for a general audience but not for children under 13 (U.S. COPPA) or under the age of digital consent in the EEA/UK (typically 16; varies by country). If you are under the relevant age, you may only use the Services with a parent/guardian’s active consent and supervision.
3) Changes to These Terms
We may update these Terms from time to time. The “Effective date” shows when changes take effect. Material changes will be reasonably notified (e.g., on-site notice). Your continued use after changes means you accept the updated Terms.
4) Accounts (If/When Offered)
If you create an account, you must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. We may suspend or terminate accounts for breach, suspected abuse, or risk to others.
5) Acceptable Use
You agree not to:
- break the law, infringe IP rights, or violate others’ privacy;
- upload or share anything unlawful, defamatory, hateful, harassing, obscene, or exploitative;
- interfere with security, scrape without permission, reverse engineer, or overload our servers;
- use bots or automation except with our written consent;
- circumvent access controls or attempt to access non-public areas;
- use the Services to advertise or solicit without authorization.
We may moderate, remove, or block content or users at our discretion where permitted by law.
6) Intellectual Property & Licenses
A. Our Content
Except where otherwise noted, all text, scripts, images, illustrations, audio, video, artwork, logos, marks, and site design on the Services (the “Content”) are owned by TrueGrimmStories or our licensors and are protected by copyright, trademark, and other laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.
You may not copy, reproduce, modify, distribute, publicly perform/display, or create derivative works from the Content without our prior written permission, except as allowed by applicable law (e.g., fair use / quotation rights).
B. Educational & Embeds
You may link to our pages and embed our publicly available YouTube videos for non-commercial educational commentary and review, provided you (i) retain attribution to “TrueGrimmStories,” (ii) do not misrepresent affiliation, and (iii) comply with the third-party platform’s terms.
C. User Submissions (UGC)
If the Services allow comments, messages, reviews, or other user-generated content (“UGC”):
- You retain ownership of your UGC.
- You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting), distribute, publicly perform/display, and otherwise use your UGC in connection with operating, promoting, and improving the Services.
- You represent and warrant that you have all rights needed to grant this license and that your UGC does not violate law or others’ rights.
- We may remove or refuse UGC at any time for any reason permitted by law.
D. Trademarks
“TrueGrimmStories,” our logos, and associated marks are trademarks or trade dress of TrueGrimmStories. Other names and logos are the property of their respective owners. You may not use our marks without written permission.
7) Copyright Notice & Takedown (DMCA / EU)
We respect intellectual property rights.
U.S. DMCA: If you believe material on the Services infringes your copyright, send a written notice to our Copyright Agent:
Email: dmca@truegrimmstories.com
Your notice must include: (1) identification of the work, (2) identification of the infringing material and its location, (3) your contact details, (4) a statement of good-faith belief, (5) a statement under penalty of perjury that your notice is accurate and you are authorized, and (6) your physical or electronic signature. We may notify the user and accept counter-notices per the DMCA.
EU/UK Notice & Action: Rightsholders may similarly notify us with sufficient detail to locate the content and demonstrate rights. We will act as required by applicable law.
8) Merchandise, Purchases & Pricing
Third-party fulfillment. Our merchandise may be sold and fulfilled by third-party platforms. That platform’s terms, privacy policy, pricing, taxes, shipping, and returns policies apply. We are not the seller of record unless explicitly stated at checkout.
If we sell directly:
- Prices are shown before checkout and may exclude taxes, duties, and shipping unless specified.
- You authorize us or our payment processor to charge the payment method you provide.
- EU/UK consumers: If you purchase physical goods from us directly, you generally have a 14-day withdrawal right from delivery; you must inform us before the deadline, and you may need to return goods in resalable condition (you bear return shipping unless we state otherwise). Digital content may begin immediately only with your express consent; once supplied, your withdrawal right may be lost as per law. We will provide the required pre-contract information where applicable.
Availability & errors. We may correct errors, change offerings, or cancel orders (with a refund if charged) where permitted by law.
9) Tips & Crypto
Tips support our work and do not purchase goods or services. Unless we state otherwise, tips are non-refundable and not tax-deductible.
Crypto: Blockchain transactions are public and often irreversible. Double-check addresses and amounts; we cannot recover mis-sent funds. Do not include personal data in on-chain memos.
10) Affiliate Links & Sponsorships
We may include affiliate links (e.g., to tools or stores such as OpenArt) and may receive a commission if you purchase. We only link to partners we think are relevant, but we do not control their sites or products. Any sponsored content will be disclosed in line with applicable laws and platform rules.
11) Third-Party Services & Embeds
The Services may link to or embed third-party services (e.g., YouTube, Instagram, TikTok, X, Facebook, PayPal, merch platforms). Your use of those services is governed by their terms and policies. We are not responsible for third-party content, policies, or practices.
12) Privacy
Your use of the Services is also governed by our Privacy Policy, which explains what data we collect and how we use it, including cookies/consent in the EEA/UK and opt-out choices in the U.S.
13) Disclaimers
- Entertainment & informational content. Our retellings are artistic interpretations of public-domain tales. We do not guarantee historical accuracy.
- No professional advice. Content is provided “as is” for informational/entertainment purposes and does not constitute legal, financial, or other professional advice.
- Service availability. We do not warrant the Services will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, the Services and Content are provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, non-infringement, and course of dealing).
14) Limitation of Liability
To the maximum extent permitted by law, we (and our directors, officers, employees, partners, and licensors) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption, arising out of or related to your use of (or inability to use) the Services, even if advised of the possibility.
Our aggregate liability for direct damages shall not exceed the greater of (i) €50 (or US$60), or (ii) the amount you paid to us (if any) for purchases on the Services in the 12 months preceding the claim.
EU/UK consumers: Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable consumer law. Your statutory rights are not affected.
15) Indemnity
You agree to indemnify and hold harmless TrueGrimmStories and our affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your UGC; (b) your breach of these Terms; or (c) your misuse of the Services, to the extent permitted by law.
16) Termination & Suspension
We may suspend or terminate all or part of the Services, or your access to them, at any time where permitted by law, including for violations of these Terms, risk to users or the platform, or to comply with legal obligations. Sections intended to survive (e.g., IP, disclaimers, liability limitations, indemnity) will survive termination.
17) International Use
The Services are controlled from [country, e.g., Cyprus] and may not be available in all languages or locations. You are responsible for compliance with local laws where you access the Services.
18) Governing Law & Venue
These Terms are governed by the laws of [Cyprus], without regard to conflict-of-laws principles. The courts of [Nicosia, Cyprus] have exclusive jurisdiction over any dispute, except that consumers in the EEA/UK may bring claims in their country of residence and rely on mandatory consumer protections there.
19) Dispute Resolution (Optional – add if you want arbitration)
(If you wish to include binding arbitration for U.S. users, insert a standard arbitration clause with class-action waiver here, ensuring required consumer carve-outs and opt-out options. Otherwise omit.)
20) Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, war, terrorism, labor disputes, internet or utility failures, platform outages).
21) Assignment
You may not assign or transfer your rights under these Terms without our consent. We may assign our rights and obligations in connection with a merger, acquisition, or asset transfer.
22) Entire Agreement; Severability; No Waiver
These Terms (plus the Privacy Policy and any posted purchase terms) are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, it will be severed or modified to the minimum extent necessary, and the remainder remains in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
23) Notices & Contact
We may send notices via the Services, email, or other reasonable means. For questions about these Terms, contact:
Email: legal@truegrimmstories.com
24) Translations
If we provide translations of these Terms, the English version controls in case of conflict.
